Apple has been found accusable of invading several patents in medical tech companies, Masimo. As a result, the importing of the apple watch series 6 and above become banned by the united states international trade commission (USITC).
A U.S. justice has governed that apple has to invade one of the Masimo crop’s pulse oximeters patents by bringing in and selling certain apple watches with illumination-based pulse oximeters performance and components. The (USITC) will now serve to fulfill an import ban on these apple watches.
The CEO of Masimo claims that without granting permission Apple has used its patents. Apple has said they admirably disagree with the conclusion and look forward to a full review of the commission.
Apple watch series 6 and later models allow tracking of oxygen levels in the blood, this includes in pulse oximeter feature.
In 2020 Masimo filed an action against apple for invading 10 different Masimo patents and requested to ban on apple watch sales in the united states. the court has made its decision the commission make the final decision and will sharply investigate apple`s pulse oximeter and its implementation, deciding whether or not apple used Masimo`s trade secrets to evolve mobile technology.
The USITC concert is independent of the court so it may reach different results. it also introduces that the USITC may not necessarily ban the apple watch 6 from imports. this is entirely possible Apple may only be structured to pay damages or face some other sort of punishment since the final decision lies with the USITC.
